The major US-based news organisations, namely CNN, MS Now, and Politico, have issued a joint statement against the Donald Trump administration. These news outlets have said to sue White House on Monday over the banning of their access to information. The statment had called it a violation of their First Amendment rights for news coverage of the US President, the New York Times reported. What is the entire issue? This statement came after the US President had declared a press ban on these three news outlets last week. The ban was allegedly imposed by the US President over what he called was the negative coverage by CNN, MS Now, and Politico. Earlier, reporters from these outlets were denied access to the White House. Additionally, CNN was removed from its duties as the White House pool representative for television networks on Monday. What did the statement say? The joint statement claimed that they had informed the U.S. government that they would be filing a lawsuit on Monday. The statement mentioned that, “Without notice or process, the White House revoked our journalists’ credentials because it objected to our reporting”. The same document further stated, “Left unchallenged, this threatens press freedom and the public’s right to independent journalism free from government interference.” Why is this unusual? The ban represents a major crackdown by Donald Trump on news organisations, particularly in Washington. The same report by the NYT said that Trump has brought friendlier outlets into the White House briefings and barred publications like the Associated Press from the Oval Office. This is also being challenged in court by AP, but he had not barred any outlets from the entire White House grounds. Press freedom advocates and other media outlets blasted the ban as unconstitutional. “No news organization — or person — should be retaliated against by the government over the words they use,” said Lauren Easton, chief communications officer for The A.P., in a Saturday statement. What had Trump actually said? In a post on Truth Social by Trump on Friday, Trump wrote that, “Media Outlets shouldn’t be able to constantly write or report FICTION and LIES” Can something like this be done in India? When it comes to India, such a ban on coverage can be imposed on a news organisation or its individual journalists. This action would bar the individual from covering events at Rashtrapati Bhavan, just like the White House. This could be done via suspension or revocation of their official media credentials. India’s law protects the freedom of speech and expression under Article 19(1)(a). However, Rashtrapati Bhavan is a highly secure, restricted-access constitutional estate. Additionally, access to cover its events is a privilege managed via formal regulatory guidelines rather than an absolute public right. This action can be undertaken after suspension or revocation of PIB accreditation. The revocation can be done because- 1. Security Concerns- If a journalist acts in a manner prejudicial to the sovereignty and integrity of India, the security of the State, or public order. 2. Legal Violations- Being charged with a serious cognizable offense, committing contempt of court, or incitement of an offense. 3. Professional Misconduct- Using credentials for non-journalistic activities, submitting fraudulent documentation, or severe violations of journalistic decency and morality. Event-Specific denial of access Rashtrapati Bhavan reserves the right to control its guest and media pool for high-profile or sensitive diplomatic events. The President’s Secretariat can limit media invites to state-run media (like Doordarshan/Prasar Bharati) or a select pool of news agencies due to- 1. Logistical Constraints- Limited seating capacities within specific halls. 2. Security Protocols- Heightened security sweeps or sanitization of the premises during international summits or high-risk state visits. Can an organisation do something in this case According to the Indian Constitution, if a news organization believes it has been arbitrarily or unfairly barred, it has the right to challenge the decision in court. The Supreme Court of India has historically ruled that any restrictions or bans placed on media outlets must be reasonable, non-arbitrary, and justifiable under the narrow criteria listed in Article 19(2) of the Constitution. The government cannot ban a news platform simply for publishing critical viewpoints or reporting on political opposition.
